Public Offer
1. General

1.1. The following terms and definitions are used in this document and in the relations of the Parties arising from or related to it:

a) Platform — software and hardware integrated with the Site by Roman Viktorovich Podvalyuk.

b) User — a legally capable individual who has joined this Agreement in his own interest or acting on behalf of and in the interests of the legal entity he represents.

c) Administration Site/Site — Internet sites located in the anticatering.ru domain and its subdomains.

d) Service — a set of services and a license provided to the User using the Platform.

e) Agreement — this agreement with all additions and amendments.

1.2. Your use of the Service in any way and in any form within the limits of its declared functionality, including:

viewing materials posted on the Site;

registration and/or authorization on the Site,

posting or displaying on the Site any materials, including but not limited to: texts, hypertext links, images, audio and video files, data and/or other information.


1.3. By using any of the above options for using the Service, you confirm that:

a) You have read the terms of this Agreement in full before using the Service.

b) You accept all the terms of this Agreement in full without any exceptions or limitations on your part and undertake to comply with them or stop using the Service. If you do not agree with the terms of this Agreement or do not have the right to enter into an agreement based on them, you should immediately stop using the Service.

c) The Agreement (including any of its parts) may be changed by the Administration without any special notice. The new version of the Agreement comes into force from the moment it is posted on the Administration’s Website or brought to the attention of the User in another convenient form, unless otherwise provided by the new version of the Agreement.

2. General terms of using the Service

2.1. Use of the functionality of the Service is permitted only after the User has registered and authorized on the Website in accordance with the procedure established by the Administration.

2.2. Technical, organizational and commercial conditions for using the Service, including its functional capabilities, are communicated to Users by separate posting on the Site or by notifying Users.

2.3. The login and password selected by the User are necessary and sufficient information for the User to access the Site. The User has no right to transfer their login and password to third parties, is fully responsible for their safety, independently choosing the method of storing them.


3. License to use the Site and permitted use of the Service

3.1. The Administration grants the registered and/or authorized User the right to free functional use of the Platform and the Site of the Administration under the terms of a simple (non-exclusive) non-transferable license within the functional capabilities of the Service.

3.2. The Administration has the right to set limits on the volume and composition of information materials posted by the User, as well as to introduce other technical restrictions on the use of the Platform and (or) the Administration Website, which will be communicated to Users from time to time in a form and manner at the discretion of the Administration.

3.3. Use of the Platform and (or) the Administration Website in other ways is strictly prohibited.


4. User Warranties

By accepting the terms of this Agreement, you confirm and warrant that:

4.1. You have all the necessary rights and powers to enter into the Agreement for the use of the Service and to execute it;

4.2. You will use the Service solely for the purposes permitted by this Agreement in compliance with its provisions, as well as the requirements of applicable law and generally accepted practice;

4.3. You will not perform any actions that conflict with or interfere with the provision of the Service or the operation of the relevant equipment, networks, or software with which the Service is provided;

4.4. Your use of the Service for specific purposes does not violate the property and/or personal non-property rights of third parties, as well as prohibitions and restrictions established by applicable law, including without limitation: copyright and related rights, rights to trademarks, service marks and appellations of origin, rights to industrial designs, rights to use images of people, the materials you provide do not contain information and/or images that offend the honor, dignity and business reputation of persons promoting violence, pornography, drugs, racial or national hatred, and you have received all necessary permissions from authorized persons in connection with the use of such materials.


5. License to use user materials

5.1. By accepting the terms of this Agreement, you grant the Administration the right to use (permission to use) the materials that you add (post or broadcast) to the Administration Website free of charge.

5.2. The specified right and/or permission to use the materials are granted to the Administration simultaneously with your addition of such materials to the Administration Site for the entire term of the exclusive rights to intellectual property objects or protection of non-property rights to the specified materials for use in the territory of all countries of the world.

5.3. Within the framework of the simple (non-exclusive) license granted to the Administration, the use of materials is permitted in the following ways:

reproduce materials, i.e. make one or more copies of materials in any material form, as well as record them in the memory of an electronic device (right to reproduce);

distribute copies of materials, i.e. provide access to the material reproduced in any form, including by network and other means, as well as by sale, rental, lease, lending, including import for any of these purposes (right to distribute);

publicly display materials (right to public display);

publicly perform materials (right to public performance);

communicate the materials in such a way that any person can have interactive access to them from any place and at any time of their choice (right of communication to the public);

modify the materials, i.e. rework or otherwise process the materials, including translating the materials from one language to another (right of processing);

the right to transfer all or part of the acquired rights to third parties (right of sublicensing).


6. Limitations

By agreeing to the terms of this Agreement, you understand and acknowledge that:

6.1. The provisions of the legislation on consumer protection shall not apply to the relations between the parties regarding the provision of the Service free of charge.

6.2. The Service is provided on an "as is" basis, and therefore you are not provided with any guarantees that the Service will meet your requirements; the services will be provided continuously, quickly, reliably and without errors; the results that may be obtained using the Service will be accurate and reliable; the quality of any product, service, information and user materials obtained using the Service will meet your expectations; all errors in the Service software will be corrected.

6.3. All responsibility for the content of the materials and its compliance with the requirements of the applicable law lies with the person who created these materials and/or added them to the Administration Site.

6.4. The Administration is in no way connected with the materials provided and/or posted (including broadcast) by Users on the Site, and does not check the content, authenticity and safety of these materials or their components, as well as their compliance with the requirements of applicable law, and the availability of the necessary volume of rights for the Users to use it.

6.5. In particular, you are prohibited from using the Service for:

posting and/or distributing counterfeit materials;

posting and/or distributing materials of a pornographic nature, as well as promoting pornography and child erotica, and advertising intimate services;

posting and/or disseminating any other prohibited information, including materials of an extremist nature, as well as those aimed at infringing on human rights and freedoms based on race and nationality, religion, language, and gender, inciting to commit violent acts against a person, or to inhumane treatment of animals, calling for the commission of other illegal acts, including explaining the procedure for the manufacture and use of weapons, drugs and their precursors, etc.;

preferential or exclusive posting of links to other sites;

dissemination of advertising materials in personal messages to other Users without obtaining their prior consent to receive them (SPAM);

restrictions using a password or other means of access to files posted on the Administration Site or broadcast to it.

6.6. Despite the established prohibition, when using the Service you may receive materials that you may consider to contain information of an offensive or obscene nature, as well as in other forms violating applicable law, the rights and/or interests of third parties.

6.7. In the event that you discover a violation of your rights and/or interests in connection with the provision of the Service, including illegal posting of materials by another User, you should notify the Administration about this. To do this, you must send the Administration a written notice with a detailed description of the circumstances of the violation and a hypertext link to the page of the Site containing the materials that violate your rights and/or interests.

6.8. In the event of any claims from third parties regarding the violation of any property and/or personal non-property rights of third parties, as well as prohibitions or restrictions established by law, you are obliged, at the request of the Administration, to undergo official identification by providing the Administration with a notarized commitment to settle the claims that have arisen on your own and at your own expense, indicating your passport data.

6.9. The Administration reserves the right to remove any materials from the Site or temporarily restrict access to them unilaterally without explanation.

6.10. In the event of repeated or gross violation of the terms of this Agreement and/or legal requirements, the Administration reserves the right to block your account entirely, delete it, or otherwise restrict (terminate) the provision of the Service.

6.11. In the event that the Administration is held liable or a penalty is imposed on it in connection with your violation of the rights and/or interests of third parties, as well as prohibitions or restrictions established by law, you are obliged to fully compensate the Administration for losses.

6.12. The Administration is not responsible for anyone’s use of publicly available personal data of Users.

6.13. Under any circumstances, the liability of the Administration is limited to 1,000 (One thousand) rubles and is imposed on it only if there is guilt in its actions.


7. Notifications

7.1. You agree to receive informational electronic messages (hereinafter referred to as "notifiers") from the Administration to the e-mail address specified in your profile on the Site about important events occurring within the Site or in connection with it.

7.2. The Administration has the right to use notifiers to inform the User about the capabilities of the Platform and (or) the Site of the Administration and / or about changes in the information resources posted on them.


8. Terms of use of personal data

8.1. By joining the terms of this Agreement, you give this written consent to the automated processing of the provided personal data for the purpose of concluding an agreement on the terms of this Agreement, as well as its subsequent execution.

8.2. In cases permitted by the functionality of the Service, you independently determine the degree of availability of your personal data to other Internet users.

8.3. You acknowledge and agree that if you post your personal data using the Service in a way that allows Internet users to obtain it, your personal data is considered publicly available. You also understand that your personal data is considered publicly available in cases where, in accordance with federal laws, it is not subject to the requirement to maintain confidentiality.


9. Other Terms

9.1. The Registered User independently determines the terms and procedure for using the account (profile) created by him/her, which, however, under no circumstances may contradict this Agreement.

9.2. Applicable Law. This Agreement, the procedure for its conclusion and execution, as well as issues not regulated by this Agreement, are governed by the current legislation of the Russian Federation.

9.3. Arbitration. All disputes under the Agreement or in connection with it are subject to consideration in court at the location of the Administration in accordance with the current procedural law of the Russian Federation.

9.4. Changes. This Agreement may be amended or terminated by the Administration unilaterally without prior notice to the User and without paying any compensation in connection therewith.
